미국 넷리스트, SK 하이닉스 수입금지 총 공세 … US ITC 조사착수

[글로벌이코노믹 김대호 기자] 이른바 US ITC로 불리는 미국 국제무역위원회가 SK하이닉스를 상대로 특허권 위반 여부에 관한 조사를 개시했다.

US ITCSSM 한국 시간 3일 미국의 반도체업체인 넷리스트(Netlist) 제기한 SK하이닉스에 대한 특허침해 조사 요구가 이유 있다고 표결하고 관세무역법 제 317조에 따라 이날 부로 공식 조사를 착수한다고 발표했다. (USITC Institutes Section 337 Investigation Of Certain Memory Modules And Components Thereof)
이번 US ITC의 SK 하이닉스에 대한 특허침해 조사는 한국의 SK hynix Inc 본사는 물론 미국 산호세의 SK하이닉스 아메리카(SK hynix America Inc) 와 SK 하이닉스 메모리 솔루션 (SK hynix memory solutions Inc) 등을 대상으로 진행된다.

조사의 쟁점은 SK하이닉스가 메모리모듈을 만들면서 미국 반도체업체 넷리스트의 특허권을 침해했는지의 여부이다.

조사결과 특허 침해여부가 사실로 입증되면 SK 하이닉스의 미국 수출이 전면 중단될 수도 있다.

다음은 미국 US ITC의 발표문 전문

The U.S. International Trade Commission (USITC) has voted to institute an investigation of certain memory modules and components thereof. The products at issue in the investigation are memory modules, for instance, circuit boards containing DRAM integrated circuits installed into a memory slot on the main circuit board of a computer.

The investigation is based on a complaint filed by Netlist, Inc., of Irvine, CA on October 31, 2017. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain memory modules and components thereof that infringe patents asserted by the complainant. The complainant requests that the USITC issue a limited exclusion order, and a cease and desist order.
The USITC has identified the following as respondents in this investigation:

SK hynix Inc., of Gyeonggi-do, Korea

SK hynix America Inc., of San Jose, CA

SK hynix memory solutions Inc., of San Jose, CA

By instituting this investigation (337-TA-1089), the USITC has not yet made any decision on the merits of the case. The USITC’s Chief Administrative Law Judge will assign the case to one of the USITC’s administrative law judges (ALJ), who will schedule and hold an evidentiary hearing. The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission.

The USITC will make a final determination in the investigation at the earliest practicable time. Within 45 days after institution of the investigation, the USITC will set a target date for completing the investigation. USITC remedial orders in section 337 cases are effective when issued and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.


넷리스트는 앞서 지난 10월 SK 하이닉스가 컴퓨터 주회로판 메모리 슬롯에 설치된 D-램 집적회로등 여러 가지 회로 판을 만들면서 특허를 침해하고 있다며 조사를 요청하는 청원서를 US ITC에 제출한 바 있다.

미국 관세무역법은 미국 기업이나 미국 개인의 지적재산권을 침해한 외국 제품에 대해 수입 금지를 명령할 수 있는 매우 강력한 조항이다. SK 하이닉스의 특허 침해 여부가 인정되면 대미 수출에 큰 타격을 받을 수도 있다.

넷리스트는 작년 9월에도 SK하이닉스의 서버용 메모리제품이 자사 미국 특허를 침해했다며 ITC에 제소한 바 있다.
